This page serves as my, Uglylilmonster’s, terms of service. It is the commissioner’s responsibility to read my terms of service on their own time and of their own initiative. I will assume the commissioner has read and agreed to these terms when a commission inquiry is initiated. Terms of service are subject to change but any change will be announced through email and/or a public announcement. Changes do not retroactively affect older commissions.
I (Uglylilmonster) wrote this document in an effort to protect both the artist (myself) and the commissioner/client (you). Both the artist’s and the commissioner’s/client’s rights are clearly outlined in this document; if you have any questions or concerns you can always email me at [email protected].

Definitions
The Artist: Me, Uglylilmonster, the person who creates the art.
The Client: You, the person who has paid for a product.
The Commissioner: You, the person who has paid for custom art.
Commission: Custom art created by the artist for the commissioner using the commissioner’s specifications.
Small commission: A single commission that costs less than or equal to $50.
Large commission: A single commission that costs more than $50.
Traditional art: Art created with traditional mediums.
Digital art: Art created with digital technology.
Product: Items created by the artist not on commission.
The Client: You, the person who has paid for a product.
The Commissioner: You, the person who has paid for custom art.

Limitations
I reserve the right to decline commissions or commission ideas for any reason.
I work on a tier system for what I will and will not produce. All extra fees are at the artist’s discretion and will be discussed between the artist and the commissioner before any monetary transactions are made; I also reserve the right to waive fees on a case-by-case basis.
Tier zero art is art I will not create under any circumstances, either for moral or legal reasons.
Tier one art is art with content I enjoy creating or have no issues creating.
Tier two art is art with content that I will draw for an extra 10%~50% fee. I may or may not publicly post or share these drawings.
Tier three art is art with content I do not enjoy creating, but I will draw for an extra 50%~100% fee. I will probably not publicly post or share these drawings.
Tier zero: Original characters without the owner’s permission or consent; bestiality involving real animals; “feral” aka animal porn; “cub” aka underage/child porn; “real” (non-fantasy or non-play) rape scenes; ultraviolence (realistic and cruel torture that could be considered realistic enough to happen IRL); hate art.
Tier three: Diapers or infantilization on adults; watersports scenes; scat or scat scenes; cartoon (non-realistic) snuff scenes; cartoon (non-realistic) squishing scenes; cartoon (non-realistic) hard vore; fantasy (non-real) animal bestiality.

Prices, Payment, and Shipping
All prices listed are base prices and they are subject to change according to the complexity, difficulty, mediums, size, or content of the piece. Shipping and handling fees and extras such as insurance, lamination, or badge clips are not factored into the base price unless otherwise stated.
I reserve the right to charge an extra fee pre- or post-completion of a commission if the commission:
As discussed in the limitations part of my ToS, I reserve the right to charge an extra fee for a commission based on its content. This fee is up to my discretion. Tier two content commissions come with an extra fee of 10%~50% of the base price of the commission. The fee for tier three content commissions is 50%~100% of the base price of the commission. I do reserve the right to waive this fee on a case-by-case basis.
If the commissioner does not want their commission posted online or shared in any way, an extra 25% fee will be added to the cost of their commission. This guarantees that I will never share the commission anywhere.
I will not ship a commission or product until the entire agreed-upon payment has been received, including cost of shipping (if applicable).
I expect full payment up front for small commissions and all products. However, on a case-by-case basis I am willing to negotiate other payment plans with the commissioner. I will not begin work on a small commission until payment has been made or an agreement has been reached between myself and the commissioner.
For large commissions I will accept half of the payment up front, and the other half upon completion. This is at the commissioner’s discretion. Again I am willing to negotiate other payment plans ahead of time on a case-by-case basis. I will not begin work on a large commission until the agreed upon payment (or first payment) has been made.
I primarily accept Paypal as payment. However, I will accept other forms or means of payment on a case-by-case basis. If you are not paying by Paypal or in person with cash, please discuss your prefered payment method with me before you discuss your commission’s content.
When sending a payment with Paypal, mark traditional art and products as “goods”, and digital art as “services”. DO NOT send your payment as a gift, “payment owed”, or any other option under the “Personal” tab.
ONLY send money as a “gift” if it really is a tip or gift.
ONLY send money as a “payment owed” if you are paying for extras such as shipping, insurance, lamination, badge clips, etc that you forgot to include in the original payment.
When you are sending your payment, only include your FA username or personal email, and small details like whether or not your payment includes shipping, lamination, etc in the comments section.

- Requires much more use of traditional media to create it than most commissions of that type. (An example of this would be a traditional art commission involving a character that has a rainbow color tail and ten other different colors for its other markings.)
- Is larger than most commissions of that type. (An example would be a commissioner asking for a 14 x 21 inch painting.)

All important contact in regards to commissions or products is to be made through email. My email is [email protected]. I am willing to discuss commissions in real time through instant messengers or comment features, but would prefer email for important details, reference images, and sensitive personal information.
It is the commissioner’s responsibility to keep up with their commission and to keep in contact with the artist about their commission. If the commissioner is unreachable or does not respond to repeated efforts on the artist’s behalf to contact them about their commission, their commission may be put on hold until contact is again established.
It is the commissioner’s responsibility to provide accurate, up-to-date references for their character(s) or subjects. It is also the commissioner’s responsibility to tell me exactly what they want for their commission, if they have an idea or scenario in mind.
It is the commissioner’s responsibility to notify the artist about whether or not their art is a gift or if it requires a deadline. Otherwise I will work under the impression that the art is not a gift and that there is no deadline.
As well, if I am told I can take my time completing a commission, I will take that into account for my work schedule. The commissioner is always free to tell me otherwise, however!
If you are commissioning art involving personal (non-commercial) characters you personally do not own, I will require written consent from the character’s owner(s). Emails, instant messages, or notes from easily verifiable accounts are all accepted. In the case of a surprise gift, proof of relationship to the character’s owner(s) (friendship or otherwise) is required.
The commissioner has the right to contact the artist at any time to inquire about the status of their commission. My work email is [email protected], my commission queue is here and my shipping queue is here if you’re curious.
The commissioner is also entitled to work in progress shots of their commission. Feel free to ask through email for a WIP shot at any time.
Large commissions will have WIP shots of each stage sent to the commissioner for approval unless asked otherwise.
It is up to the commissioner to request WIP shots for every stage of their commission in regards to small commissions.
Requests for revisions to a work are to be made promptly and before the commissioner approves of a WIP. It is the commissioner’s responsibility to let me know that revisions are needed. For small commissions I will only make three revisions for free.
The artist reserves the right to charge an extra fee in the event that many revisions are made to a commission, including but not limited to completely re-doing an entire stage of the commission process (sketching, inking, or coloring).
The artist reserves the right to cancel a commission and issue a complete or partial refund at any time. Complete refunds will be issued in the case of an unstarted commission, and partial refunds will be issued in the case of a started commission.
The commissioner has the right to request a refund before the inking stage of their commission is complete. Refunds will be issued on a case-by-case basis and will be sent through Paypal’s payment owed option, sans any Paypal fees taken from the original payment.
Partial refunds will be issued in light of any completed work for the refunded commission, based on an $8/hour frame. Partial refunds will also include any completed work, sent in a 300 DPI .png format through email.
Example: $60 painting of a unicorn. A detailed under-sketch has been made through almost three hours of work, but the commission was canceled. A refund of $40 is sent to the commissioner as is a 300 DPI scan of the sketch work.

The commissioner (and any persons whose characters are included in the commission) has every right to re-post the work(s) I have created for them as they see fit, so long as the commissioner (and all other parties) provides credit to me as the artist.
The commissioner has the right to personal, non-commercial use of their commission. This includes editing their artwork for personal digital use (icons, banners, wallpapers) or printing their artwork for personal use. The commissioner cannot use their commission commercially or to make a profit unless they have bought the rights to do so. If I find my work being used commercially or to make a profit I will take action.
The commissioner has the right to re-sell a traditional commission they bought from me, so long as they do not do so to make a profit. You may sell the work(s) for the same or less than what you bought it for.
